N.H. Admin. Code § Csp 304.03
The trust shall enter into one or more agreements with a private vendor or vendors with respect to the establishment, operation and administration of the trust. The private vendor or vendors shall provide such services as shall be specified in the agreements. In negotiating such agreements, the trust shall negotiate specific, case by case, contract terms with each private vendor in order to advance the best interest of the trust, as specified in Csp 301.01. After these negotiations are complete, the terms shall be approved by the commission then sent to the governor and executive council for their approval. For purposes of these administrative rules, actions indicated as taken or to be taken by the "trustee" shall include actions taken by such a private vendor or vendors in accordance the terms of such agreements.
