N.H. Admin. Code § Csp 302.07
The trust documents shall provide that the trustee shall amend the trust documents at any time if the trustee determines that such an amendment is required to maintain qualification of the plan as a qualified state tuition program. The trust documents shall further provide that the trustee shall amend the trust documents upon the direction of the commission, subject to approval by the governor and executive council, by giving notice of such amendment to the participants, subject to such restrictions as shall be expressly set forth in the trust documents. The commission shall give such direction, if necessary to encourage additional college savings and to keep the New Hampshire plan competitive with those sponsored by other states.
