Section Csp 302.03 - Contributions Barred in Certain Circumstances

The trust documents shall provide for a limitation on contributions based on the aggregate value of all accounts in existence for the benefit of a particular designated beneficiary. This limitation, which shall be reviewed and determined annually by the commission, shall not exceed an amount that is reasonably necessary to provide for the higher education expenses of the designated beneficiary. The contribution limitation shall satisfy the prohibition on excessive contributions as set forth in the Code. The trustee or the trustee's representative shall not accept any portion of a contribution to any account in existence for the benefit of a designated beneficiary to the extent that such contribution exceeds the difference between the contribution limit for such calendar year and the annual adjusted account base as of December 31 of the year preceding the year in which the proposed contribution is received by the trustee or the trustee's representative. The provisions of this rule shall meet the requirements of, and shall be construed consistent with, section 529(b)(6) of the Code by the trustee, the commission, each participant and each beneficiary.
