Section Asb 202.02 - Disposition of a Rulemaking Petition(a) The board shall consider all petitions for rulemaking and proceed pursuant to RSA 541-A:4.(b) The board shall request additional data or argument as necessary from the petitioner to clarify the petition.(c) If the data or argument fails to support the petition, the board shall state the reason therefore in a letter to the petitioner.(d) Denial of a petition shall be final and the person filing such petition, or any other interested person, shall not be entitled to request an adjudicative proceeding under this chapter.(e) If the data or argument supports the petition, the board shall commence rulemaking proceedings as provided in RSA 541-A:3 except in instances where there is a valid reason for denial such as, but not limited to, lack of rulemaking authority.N.H.
