Section 90.495 - Claim of exemption: Applicable fee and filing requirements; burden of proof when filing not required1. If a person claims a statutory exemption from the registration requirement of NRS 90.460 and if the person is required to file a notice with the Administrator in order to claim the exemption, the person must file a Claim of Exemption From Securities Registration (Nevada Form N-9), together with any other materials required pursuant to the section of statute or regulation which establishes the exemption and the stated fee.2. Regardless of whether an exemption from registration requires the filing of a Claim of Exemption From Securities Registration (Nevada Form N-9) with the Administrator, the burden of demonstrating the availability and applicability of the exemption is on the person claiming the exemption.Nev.
