Section 702.270 - "Multiple retail customers under common ownership and control" interpreted1. For the purposes of NRS 702.160 and NAC 702.150 to 702.450, inclusive, "multiple retail customers under common ownership and control" means a combination of two or more retail customers in which a single person possesses: (a) Directly or indirectly, a legal ownership interest of at least 5 percent in each of the retail customers; and(b) Control over each of the retail customers.2. As used in this section, "control" means the possession, direct or indirect, of the power and authority to direct the management and major policies of a retail customer, whether through ownership of voting securities, by contract other than a commercial contract for goods or nonmanagement services or otherwise, unless the power and authority is the result of an official position with or corporate office held by the retail customer.
