Section 648.440 - Disciplinary hearings: Procedure
1. The Chair, member or hearing officer appointed to conduct the hearing shall convene it at the time and place specified in the notice. The presiding officer may continue the hearing without further notice for good cause.
2. The decision of the Board will be based exclusively on substantive evidence adduced at the hearing and upon matters officially noticed.
3. Each board member may use his or her experience, technical competence and specialized knowledge in the evaluation of evidence.
4. The presiding officer shall begin the hearing by reading the complaint and the notice of the hearing into the record. The hearing will be conducted in the following order unless the Board or hearing officer, for good cause shown or to prevent manifest injustice, orders otherwise:
(a) An opening statement may be made on behalf of the Board.
(b) An opening statement on behalf of the licensee, which may be made, reserved until the close of the hearing or waived.
(c) Presentation of the Board's case, followed by cross-examination.
(d) Presentation of the licensee's case, followed by cross-examination.
(e) Rebuttal, limited to issues previously raised. No new matter may be presented at this time unless the Board so permits for good cause shown.
(f) Argument on behalf of the Board, which may be waived.
(g) Argument on behalf of the licensee, which may be waived.
(h) Submission of the matter for decision.
