Section 608.330 - Periodic evaluation of worker's productivityIf a worker with a disability is employed under a certificate at an hourly rate:
1. An evaluation of his productivity must be made within 30 days after his employment begins to determine the appropriate rate of pay. The results of the evaluation must be recorded and the wages of the worker adjusted accordingly not later than the first complete pay period following the evaluation.2. Upon the completion of not more than 6 months of employment by the worker, the employer must conduct a review of the quantity and quality of work of the worker as compared to that of nondisabled workers engaged in similar work or work requiring similar skills. The results of the review must be recorded.3. The productivity of the worker must be reviewed and the findings recorded during the 6 months immediately following the initial review and at least every 6 months thereafter. The wages of the worker must be adjusted accordingly not later than the first complete pay period following each review.Nev. Admin. Code § 608.330
