Section 534.Sec. 14 - NEW1. The State Engineer may, for good cause shown, grant an extension of the time in which a waiver granted pursuant to any of the provisions of NAC 534.440 to 534.449, inclusive, or section 13, is valid. The State Engineer may grant any number of extensions but, except as otherwise provided in this subsection, a single extension of time must not exceed 1 year. If the applicant for an extension of a waiver demonstrates to the satisfaction of the State Engineer that the applicant has sufficient need for an extension that exceeds 1 year, the State Engineer may grant an extension of a waiver for not more than 5 years.2. A request for an extension of a waiver made pursuant to this section must be: (a) Submitted to the State Engineer on a form prescribed by the Division within 30 days before the waiver is set to expire; and(b) Accompanied by proof demonstrating sufficient need for the extension of time.3. A person may file a single request for an extension of time pursuant to this section for all waivers of the same type held by that person.4. The State Engineer will not grant an extension of time unless the State Engineer determines that the proof submitted by the applicant demonstrates sufficient need for the extension. The failure to provide any proof is prima facie evidence that the applicant has not demonstrated sufficient need for the extension.5. If a person does not file a request for an extension of time for a waiver within 30 days after the waiver expires, the State Engineer will notify the holder of the waiver that the person has 30 days from the date on which the notice was mailed to file a request for an extension of time for a waiver pursuant to this section or the waiver will be permanently expired.Nev.
