Section 534.Sec. 11.1 - NEW1. Except as otherwise provided in NAC 534.310, any work related to a waiver requested pursuant to NAC 534.440 to 534.450, inclusive, and sections 11 to 14, inclusive, of this regulation must not proceed until the State Engineer grants written approval of the waiver.2. If a waiver is approved by the State Engineer pursuant to NAC 534.440 to 534.450, inclusive, and sections 11 to 14, inclusive, of this regulation, the waiver is subject to the terms and conditions set forth in the approval of the waiver. The issuance of a waiver does not waive the requirements of any other federal or state agency or local government.3. Notwithstanding the provisions of NAC 534.440 to 534.450, inclusive, and sections 11 to 14, inclusive, of this regulation, in the event of a public health emergency or other exceptional circumstance, a person may verbally request a waiver from the Division. If the State Engineer approves the waiver, the application for a waiver and the fees required pursuant to NAC 534.440 to 534.450, inclusive, and sections 11 to 14, inclusive, of this regulation must be submitted to the Division within 3 business days after the approval of the waiver is granted.4. As used in this section, "public health emergency or other exceptional circumstance" does not include the convenience of the applicant.Nev. Admin. Code § 534.Sec. 11.1
