Section 459.238 - Specific licenses: General requirements; reasons for denial1. An application for a license will be approved if the Division determines that:(a) The applicant is qualified by reason of training and experience to use the material in question for the purpose requested in accordance with the provisions of NAC 459.010 to 459.950, inclusive, and sections 4 to 28, inclusive in a manner to minimize danger to public health and safety or property;(b) The applicant's proposed equipment, facilities and procedures are adequate to minimize danger to public health and safety or property;(c) The issuance of the license will not be inimical to the health and safety of the public;(d) The applicant satisfies the requirements set forth in section 12; and(e) The applicant satisfies any applicable special requirements in NAC 459.236 to 459.307, inclusive, and sections 12 to 26, inclusive,.2. The Division will deny an application for a license if the Division determines that:(a) The issuance of the license would be inimical to the health and safety of the public;(b) The applicant does not satisfy the requirements of paragraph (a), (b), (d) or (e) of subsection 1; or(c) The applicant has held a license authorizing a similar use of radioactive material issued by the Division or by the appropriate licensing agency in another jurisdiction and the license has either been revoked or the licensee has been cited for a violation, which the Division deems significant, of a regulation relating to matters of health and safety.Nev.
