Section 445B.318 - Operating permits: Requirement for each source; form of application; issuance or denial; posting1. An operating permit is required for each new or existing stationary source.2. Application for the issuance of an operating permit or a replacement for a lost or damaged operating permit must be submitted in writing to the Director on the exact form provided by the Director.3. An operating permit must be granted if the Director finds from a stack emission test or other appropriate test and other relevant information that use of the stationary source will not result in any violation of the air quality regulations or the provisions of 40 C.F.R. § 52.21 or 40 C.F.R. Parts 60, 61 and 63, adopted by reference in NAC 445B.221.4. A denial of an application for an operating permit must be accompanied by a statement of the reasons for the denial, and, if the Director has relied in his or her decision upon information not contained in the application, the statement of reasons must identify and state the substance of such information.5. Operating permits must be posted conspicuously at or near the stationary source.Nev. Admin. Code § 445B.318
