Section 445B.3453 - Application: General requirements
1. Except as otherwise provided in subsection 3, an owner or operator of any Class II source must submit an application for and obtain a Class II operating permit .
2. For a proposed Class II source or a proposed modification to a Class II source , an owner or operator must file an application and obtain a Class II operating permit or a revision to an existing Class II operating permit before commencing construction of the proposed stationary source or the proposed modification.
3. The owner or operator of a thermal unit that emits mercury which is located at a Class II stationary source shall comply with the provisions of NAC 445B.3611 to 445B.3689, inclusive. As used in this subsection, "thermal unit that emits mercury" has the meaning ascribed to it in NAC 445B.3643.
