Section 445A.Sec. 12 - NEWIf a parameter of concern in a surface water or segment thereof is designated as having a tier 2 level of antidegradation protection, the Department:
1. Shall, except as otherwise provided in subsection 2, maintain and protect the baseline water quality or interim baseline value, as applicable, or any requirement to maintain existing higher water quality; and2. May authorize a new or expanded point source discharge that will degrade the baseline water quality or interim baseline value, as applicable, or any requirement to maintain the existing higher water quality if the discharge is approved by the Commission pursuant to section 17.Nev. Admin. Code § 445A.Sec. 12
