Section 445A.9706 - Enforcement action for violation of regulations1. A person who owns or operates an on-site sewage disposal system in violation of any applicable provision of NAC 445A.950 to 445A.9706, inclusive, or the provisions of the applicable permit issued by the Division or other administrative authority may be subject to an enforcement action pursuant to NRS 445A.675 and 445A.690 to 445A.705, inclusive.2. Violations of a permit may include, without limitation:(a) Failure to collect, analyze and report sampling results.(b) Submission of any misleading or inaccurate information relating to the on-site sewage disposal system to the Division or other administrative authority.(c) Submission of any fraudulent information to the Division or other administrative authority, including, without limitation:(1) Measurements or test results for which measurements or tests were not conducted;(2) Measurements or test results obtained by deliberately and knowingly making measurements or collecting test samples at times and places other than those specified in the permit or in NAC 445A.950 to 445A.9706, inclusive; or(3) Test results obtained through the use of unapproved or erroneous procedures for sampling, preservation, storage or analysis.
