Section 445A.67594 - Environmental impact statement: When requiredThe Division shall require an applicant to prepare and submit an environmental impact statement if the Division determines that:
1. The applicant's proposed water project is not eligible for a categorical exclusion or a finding of no significant impact; and2. The water project is known or expected to:(a) Have a significant effect on the quality of the human environment, individually, cumulatively over time or in conjunction with other federal, state, local or private actions; or(b) Affect, directly or indirectly, recognized: (2) Habitats of endangered or threatened species;(3) Environmentally important natural resource areas, including, without limitation: (III) Environmentally significant agricultural land;(IV) Aquifer recharge zones;(VI) Other resource areas.Nev.
