An operator shall not openly burn hazardous waste except for the open burning and detonation of waste explosives. For the purposes of this section, waste explosives include waste which has the potential to detonate and any bulk military propellants which cannot safely be disposed of through other treatment. For the purposes of this section, detonation is an explosion in which chemical transformation passes through the material faster than the speed of sound. An operator who openly burns hazardous waste or detonates waste explosives shall do so in accordance with 40 C.F.R. Part 264, Subpart X, as adopted by reference in NAC 444.8632, and the following table and in a manner that does not threaten human health or the environment.
