Section 432A.Sec. 5 - NEW

For the purposes of sections 2 to 34, inclusive, of this regulation, the Division shall determine that a facility is in substantial compliance with those provisions if the Division determines that:

1. No deficiency with a severity score of three or more is present at the facility; and

2. The facility has taken effective steps to resolve all deficiencies.
