Section 388.225 - Prohibition on requiring medication of pupil; consulting or sharing certain observations with parent
1. A person employed by a public agency shall not require a pupil or a parent of a pupil to obtain a prescription for the pupil for a substance covered by the Controlled Substances Act, 21 U.S.C. §§ 801 et seq., as a condition of attending school, receiving an evaluation for special education or related services pursuant to NAC 388.330 to 388.440, inclusive, and section 10 of this regulation or receiving special education or related services.
2. This section does not prohibit a teacher or other school personnel from consulting or sharing classroom-based observations with a parent of a pupil concerning:
(a) The academic achievement and functional performance of the pupil;
(b) The behavior of the pupil while in the classroom, on the premises of any public school, at an activity sponsored by a public school or on any school bus; or
(c) The need for the pupil to be evaluated for special education or related services.
