Section 370.575 - Failure to appear

If:

1. A respondent fails to appear at a hearing;
2. The hearing officer has not granted a continuance;
3. The Department offers proof that the respondent was given proper notice of the hearing; and
4. The hearing officer makes a determination that the respondent was given proper notice of the hearing, the hearing officer may proceed to consider the case on its merits without the participation of the respondent and dispose of the case based on the evidence before him or her.
