Section 281A.470 - Failure of subject to appear at hearing or reply to notice1. Unless otherwise directed by the Commission or the presiding officer, as applicable, the subject of an ethics complaint is not required to appear personally at any hearing relating to the ethics complaint except an adjudicatory hearing.2. If the subject fails to appear at an adjudicatory hearing scheduled by the Commission or fails to reply to the notice provided pursuant to NAC 281A.410 and a continuance has not been requested or granted, upon an offer of proof by the Executive Director that the subject was given proper notice and upon a determination by the Commission that proper notice was given, the Commission may consider the alleged violations specified in the determination of the review panel to be true or may proceed to consider the case without the presence of the absent subject and may dispose of the matter on the basis of the evidence before it.Nev.
