Section 439-1-001

The Secretary shall classify trademarks and service marks, to the extent practicable, to conform to the classification system adopted by the United States Patent and Trademark Office, and shall update the classification through the rule and regulation process to conform to such classification system when necessary.

01.01 If the classification of goods and services changes pursuant to these regulations, the new classification applies only to applications filed on or after the effective date of the change.

01.02 In a registration resulting from an application that was filed before the effective date of a change to the trademark regulations, the owner may amend the registration to comply with the requirements of the current trademark regulations. The owner must pay the recording fee.
