A permit granted pursuant to Neb. Rev. Stat. § 46-613.01 may be revoked, following a hearing, if the Department determines that the permitholder has failed to exercise the right to withdraw ground water within three years of the date the permit was approved, or for a period of three consecutive years thereafter. Permits may not be modified to include additional amounts of withdrawal or additional wells. New permits will be required for such modifications.
