Section 477-27-009 - EMERGENCY MEDICAL SERVICES ASSISTANCE (EMSA)Emergency medical services may be provided to certain individuals who do not have a qualified non-citizen status for Medicaid. The individual must be eligible for a category of Medicaid assistance except for citizenship or a qualified non-citizen status. Only coverage for emergency services will be authorized.
009.01EMERGENCY MEDICAL CONDITION. An emergency medical condition is defined as a medical condition, including emergency labor and delivery, manifesting itself by acute symptoms of sufficient severity, including severe pain, where the absence of immediate medical attention could reasonably result in: (A) Serious jeopardy to the patient's health;(B) Serious impairment to bodily functions; or(C) Serious dysfunction of any bodily organ or part.009.02EMERGENCY SERVICE AUTHORIZATION. To be considered eligible for emergency medical services for aliens (EMSA), the state review team (SRT) will determine that the individual has an emergency medical condition.009.03EFFECTIVE DATE. Emergency medical services for aliens (EMSA) is not subject to the provisions at 477 NAC 4 regarding the effective date of Medicaid eligibility. Eligibility for the program is limited to the time necessary to treat the emergency medical condition.
