Section 477-24-007 - EMERGENCY MEDICAL
007.01 Emergency Medical Assistance for Undocumented and Ineligible Aliens

An emergency medical condition is defined as a medical condition (including emergency labor and delivery) manifesting itself by acute symptoms of sufficient severity (including severe pain) where the absence of immediate medical attention could reasonably result in:

1. Serious jeopardy to the patient's health;
2. Serious impairment to bodily functions; or
3. Serious dysfunction of any bodily organ or part.
007.02 Eligibility for Emergency Medical Services for Undocumented and Ineligible Aliens
24-007.02ARestricted Medical Assistance: To be considered eligible for Emergency Medical Assistance Services, the State Review Team (SRT) shall determine that the individual has an emergency medical condition.

The alien shall be determined eligible under the appropriate Medicaid category by meeting all eligibility criteria except citizenship or qualified alien status.
