The transcript of the public hearing shall be filed at the time the Recommended Order and Decision of the Hearing Officer is filed. The Commission shall review the record of the public hearing and the Recommended Order and Decision of the Hearing Officer. The Commission may affirm or modify in whole or in part the Recommended Order of the Hearing Officer. If the Commission modifies in whole or in part the Recommended Order and Decision of the Hearing Officer, it shall write its Final Order and Decision from the record of the public hearing and upon evidence of which judicial notice may be taken by courts of record in the State of Nebraska. The Commission may utilize a telephone conference call to render a Final Order and Decision after a public hearing, provided appropriate public notice has been made.
