PURPOSE: This rule sets forth the authorization for the director of the Department of Natural Resources, in his/her capacity of administering Department of Natural Resources program, to delegate the review, reevaluation and approval/denial of construction permits, operating permits and permits to withdraw/inject water from/into subsurface wells.
(1) It is the responsibility of the Department of Natural Resources (DNR) to issue or deny Clean Water Commission permits. Authority to issue/deny Clean Water Commission permits rests with the director of DNR acting in his/her capacity of administering DNR programs. This authority may be delegated by letter from the director of the DNR to his/her designee. Denial of a Clean Water Commission permit will be by a certified letter that states-(A) The permit is being denied;(B) The reason(s) that the permit is being denied;(C) Any action that the permittee could take to mitigate the denial and eventually secure the permit; and(D) The permittee's right to appeal the staff denial to the Clean Water Commission within thirty (30) days.
