Section 1 CSR 50-4.010 - Representation by a Licensed Attorney; When RequiredPURPOSE: This rule states when and how a party must be represented by a licensed attorney.
(1) Upon receiving notice of a complaint filed with the commission pursuant to section 105.957, RSMo, or a notice of investigation pursuant to section 105.959, RSMo, any person is entitled to be represented by counsel before the special investigator or the commission.(2) A licensed attorney shall file a written entry of appearance on behalf of any person with the commission prior to any contact between the attorney and the special investigator or commission staff regarding the substance of an investigation. The entry of appearance shall state the persons and entities represented before the commission. An attorney filing a written entry of appearance for limited purposes shall adhere to Missouri Supreme Court Rules of Civil Procedure regarding entries of limited appearance.(3) An entry of appearance filed with the commission shall be deemed to continue during any proceeding before the commission initiated pursuant to subsection 3 of section 105.961, RSMo.(4) An attorney not authorized to practice in Missouri shall enter an appearance in accordance with Missouri Supreme Court Rules.Adopted by Missouri Register January 15, 2016/Volume 41, Number 02, effective 2/29/2016
