Rule 40-2-2.8 - PROHIBITION ON USE OF NATURAL CERVID URINEA. For the purpose of this rule, cervids include any member of the Cervidae family, including white-tailed deer, elk, moose, red deer, sika deer, fallow deer, mule deer and caribou. B. Chronic Wasting Disease scientific research indicates infection prions are found in bodily fluids of cervids. C. Beginning, July 1, 2019, it shall be unlawful to use scents or lures that contain natural cervid urine, biofluids, or biological material, for hunting purposes. D. This prohibition shall not apply to any natural cervid urine product that has been certified as coming from a facility that has not tested positive for Chronic Wasting Disease, as long as the testing protocols include, but are not limited to, requirements that the producing facility: 1. complies with testing protocols adopted by the Archery Trade Association (ATA), to include record-keeping requirements and testing of the natural urine product; 2. does not allow importation of live cervids; 3. requires that all cervids exported from the facility be tested for chronic wasting disease upon death, and the results are reported to the facility; 4. is inspected annually by an accredited veterinarian, including inspection of the herd and applicable records; and 5. maintains a fence that is at least eight (8) feet high around the facility and, if the facility is located within thirty (30) miles of a confirmed positive detection of an occurrence of chronic wasting disease, is double-fenced to prevent direct contact between captive and wild cervids.
