Maintained pavement projects are projects wherein a contractor must construct and maintain the pavement to certain pavement distress level thresholds. Remedial actions are required whenever distress levels are not met. The pavement is maintained by the contractor for an agreed-upon period (generally 5, 7, or 10 years). The Code of Federal Regulations, Title 23, Section 635.413 (which is available at www.gpoaccess.gov), allows for warranty provisions in construction contracts.
