Rule 31-2-8.2 - Procedure1. The Center will provide a Release form to the individual which must be signed prior to the check being performed. This release form authorizes the Center to conduct the record check and waives any and all claims of liability against the Center and the Department of Public Safety concerning the inquiry and release of any and all criminal records information associated with the inquiry. A copy of the Release form is provided in Section 8.0.1.2. The individual will be fingerprinted by a fingerprint examiner from the AFIS Division or other certified law enforcement personnel. The fingerprint image will be captured by rolling the prints on a fingerprint card or by a live-scan machine. Fingerprinting is required to ensure the record's security, to verify the identities of those who seek to inspect them, and to maintain an orderly and efficient mechanism for such access.3. The fingerprint image will be checked against the state database and submitted to the Federal Bureau of Investigation for a review of the federal records database. When the results of the fingerprint checks are received, the Special Processing staff will contact the individual or his/her attorney to schedule a time for inspection of the record, if such record exists. This record will be made available only to the requesting individual or his/her attorney and will not be made available to a third party by the Center. All inquiries concerning federal records will be directed to the Federal Bureau of Investigation.4.
