Section 24-8-4-6 - Administrative AppealA. An individual aggrieved by a decision regarding the initial application for professional licensure, default of a program Participant or the application for renewal of professional licensure has the right to appeal to the Executive Director. The individual must notify the Division and provide any supplemental application information within thirty (30) days of receipt of written notification of application review results. The Executive Director shall review the application and supplemental information, if provided, and notify the individual of the results of this review within thirty (30) days.
B. An individual aggrieved by the decision of the Executive Director may then appeal to the State Board of Mental Health. The individual must notify the Division within fifteen (15) days of receipt of written notification of the Executive Director's decision. The State Board of Mental Health shall review the individual's record and notify the individual of the results of this review within forty-five (45) days.
