Rule 18-1-5.2 - Establishing Programmatic Division OverpaymentsA. The Benefit Recovery Unit will receive the overpayment claim referral from the appropriate programmatic division with MDHS.B. The overpayment type will be determined and routed to the Division of Investigations or the Division of Administrative Hearings if found to be an Intentional Program Violation.C. All other overpayment types will be handled by the Benefit Recovery Unit, who will issue a Demand Letter to the client, subgrantee, provider, etc. within fourteen (14) business days of receiving the overpayment claim referral.
