Rule 18-1-3.8 - Responsible Persons for TANF OverpaymentsA. Using guidelines dictated by federal regulations and State law, the Benefit Recovery Unit has chosen to recover from only assistance group members who were adult members (18 years of age or older) at the time the overpayment occurred. Individuals who were children in the assistance group at the time of overpayment will not be liable.B. The priority of recovery action against overpaid TANF recipients looks to the caretaker relative recipient first to recover the overpayment because that person is generally responsible for the overpayment. However, if the caretaker relative is unavailable due to death or disappearance, then the agency must seek recovery from other members of the debt, 18 years and older. Miss.
