Rule 18-1-2.12 - BankruptcyA. SNAP Intentional Program Violations (IPV) debts are not dischargeable debts when filing for bankruptcy.B. Once MDHS becomes aware that bankruptcy has been filed by a client with an outstanding SNAP overpayment, the Benefit Recovery Unit must: 1. Cease collection during the automatic stay,2. File a Proof of Claim by the deadline required,3. Notify the Attorney General Office of the bankruptcy case, and4. Resume collections once automatic stay is no longer in effect.
