Rule 15-16-1-45.56.9 - Authority of Temporary ManagerThe temporary manager shall not have the authority to do the following:
1. To cause or direct the facility or its owner to incur debt or to enter into any contract with a duration beyond the term of the temporary management of the facility;2. To cause or direct the facility to encumber its assets or receivables, or the premises on which it is located, with any lien or other encumbrances;3. To cause or direct the sale of the facility, its assets, or the premises on which it is located;4. To cause or direct the facility to cancel or reduce its liability or casualty insurance coverage;5. To cause or direct the facility to default upon any valid obligations previously undertaken by the owners or operators of the facility, including but not limited to, leases, mortgages, and security interests; and6. To incur capital expenditures in excess of two-thousand dollars ($2,000.00) without the permission of the owner of the facility and the licensing agency.15 Miss. Code. R. 16-1-45.56.9
