Rule 15-12-31-4.9.1 - Grounds for Suspension or Revocation include:
1. Fraud or any misstatement of fact in the procurement of any certifications or in any other statement of representation to the Board or its representatives.
2. Gross negligence.
3. Repeated negligent acts.
4. Incompetence.
5. Disturbing the peace while on duty.
6. Recklessly disregarding the speed regulations prescribed by law while on duty.
7. Failure to maintain current registration by the National Registry of EMTs.
8. Failure to maintain all current training standards as required by BEMS.
9. The commission of any fraudulent, dishonest, or corrupt act which is substantially related to the qualifications, functions, and duties of pre-hospital personnel.
10. Conviction of any crime that is directly related to the qualifications, functions, and duties of pre-hospital personnel. The record of conviction or certified copy thereof will be conclusive evidence of such conviction.
11. Violating or attempting to violate directly or indirectly, or assisting in or abetting the violation of, or conspiring to violate, any provision of this part of the regulations promulgated by the State Department of Health, BEMS, pertaining to pre-hospital personnel.
12. Violating or attempting to violate any federal or state statute or regulation which regulates narcotics, dangerous drugs, or controlled substances.
13. Unauthorized, misuse or excessive use of narcotics, dangerous drugs, or controlled substances or alcoholic beverages.
14. Functioning outside the Medical First Responder scope of practice.
15. Permitting, aiding, or abetting an unlicensed or uncertified person to perform activities requiring a license or certification.
16. Failure to comply with an employer's request for drug and alcohol testing.
17. Failure to wear high visibility safety apparel that meets the requirements of the American National Standard for High Visibility Apparel ANSI/ISEA 107-2004 Performance Class 2 or Performance Class 3, or the ANSI/ISEA 207-2006 Standard while functioning within the right-of-way of any road, street, highway, or other area where vehicle or machinery traffic is present. (Suspension only for first offense.)
18. Any conduct, regardless of whether convicted, which constitutes a crime of violence, or which constitutes any of the following crimes:
a. Assault
b. Stalking
c. False imprisonment
d. Sexual assault or battery
e. Crimes against a vulnerable person
