Rule 15-12-31-1.15.4

The decision to suspend, revoke or deny a license shall become final thirty days after it is mailed or served unless the applicant or licensee within such thirty days, appeals the decision to the Chancery Court of the county where the applicant or licensee is domiciled. The certified personnel or licensed service shall have the burden of proving that the decision of the State Health Officer was not in accordance with applicable law and these regulations.

If a certified personnel or licensed service is allowed to operate during the appeal process, they will remain under the regulation of MSDH and will be subject to all certification and licensure regulations.
