Rule 13-3-8.5 - Presentation Of Evidence(a) Oral evidence may be taken only upon oath or affirmation administered by the hearing examiner.(b) Affidavits may be received in evidence as provided in subsection 3 of Miss. Code Ann. § 75-76-111.(c) Each party may: 1. Call and examine witnesses;2. Introduce exhibits relevant to the issues of the case, including the transcript of testimony at any investigative hearing;3. Cross-examine opposing witnesses on any matter relevant to the issues of the case, even though the matter was not covered in a direct examination;4. Impeach any witness, regardless of which party first called him to testify; and5. Offer rebuttal evidence.(d) If a party does not testify on his own behalf he may be called and examined as if under cross-examination. (Adopted: 09/25/1991; Amended: 03/29/1993.)Miss.
