Section 12-8-400.3 - UTILITIES(1)Utilities Included in Base Rent - Where provided by Lessor and included in Base Rent, Lessor shall have complete responsibility for providing all utilities and paying any/all applicable utility providers on a regular and prompt basis so as to prevent any disruption in provision of utilities to Lessee. (2)Utilities Excluded from Base Rent - Any utility excluded from Base Rent shall be the responsibility of the Lessee, however; the ability to meter the usage of any such utility solely within the leased Occupant Area must be provided by Lessor. Utilities that are excluded from Base Rent shall not be permitted to be billed to the Lessee by the Lessor as additional or pass-thru charges by means of pro-rated values or calculations derived from bills from utility providers in the name of the Lessor. In no instance shall Lessee be responsible for additional charges for utility usage of Building Amenity Areas or Building Service Areas. 12 Miss. Code. R. 8-400.3
