Rule 1-5-10.6 - Unauthorized practice of lawA. If notarial certificate wording is not provided or indicated for a document, a nonattorney notary shall not determine the type of notarial act or certificate to be used.B. A notary public may not assist a person in drafting legal documents, give legal advice or is otherwise practice law in violation of Section 43 of the Act (relating to prohibited acts), unless the notary public is a licensed attorney in this State.C. Among the acts that constitute the practice of law are the preparation, drafting or selection or determination of the kind of any legal document, or giving advice in relation to any legal documents or matters.D. A person who represents himself in a legal matter will not be considered to have engaged in the unauthorized practice of law.E. This section does not preclude a notary public who is duly qualified, trained, or experienced in a particular industry or professional field from selecting, drafting, completing, or advising on a document or certificate related to a matter within that industry or field.1 Miss.
