Rule 1-4-9.1 - Policy StatementThe duties and responsibilities of the Mississippi Secretary of State with respect to the administration of the UCC are ministerial. In accepting for filing or refusing to file a UCC document pursuant to these rules, the filing officer does none of the following:
A. Determine the legal sufficiency of a document.B. Determine that a security interest in collateral exists or does not exist.C. Determine that information in the document is correct or incorrect, in whole or in part.D. Create a presumption that information in the document is correct or incorrect, in whole or in part except as authorized by section 75-9-501.1 of the Mississippi Code of 1972 as amended.Section 75-9-501.1 and Section 75-9-519 et seq.
