Part 7049.1000 - APPROVAL PROCEDURES FOR NONSUBSTANTIAL MODIFICATIONSA. The POTW authority shall notify the agency of any nonsubstantial modification at least 45 days prior to implementation by the POTW, in a statement as provided for in part 7049.0990.B. Within 45 days after the submission of the POTW's statement, the agency shall notify the POTW of its decision to approve or deny the nonsubstantial modification, except as provided in item C.C. If the agency does not notify the POTW within 45 days of its decision to approve or deny the modification, or to treat the modification as substantial under parts 7049.0980 and 7049.0990, the POTW authority may implement the modification.Statutory Authority: MS s 115.03
