The owner and occupant of any premises, business establishment, or industry is responsible for the satisfactory storage of all solid waste accumulated at that premise, business establishment, or industry.
Garbage and similar putrescible waste must be stored in:
Refuse must be stored in durable containers or as otherwise provided in this part. Where garbage and similar putrescible wastes are stored in combination with nonputrescible refuse, containers for the storage of the mixture must meet the requirements for garbage containers in subpart 2.
All containers for the storage of solid waste must be maintained in such a manner as to prevent the creation of a nuisance or menace to public health. Containers that are broken or otherwise fail to meet requirements of this part must be replaced with acceptable containers.
Solid waste objects or materials too large or otherwise unsuitable for storage containers must be stored in a pollution and nuisance free manner and in compliance with the regulations of federal, state, and local governments, and their regulatory agencies.
Municipal solid waste combustor ash must be stored in a manner which minimizes the emission of fugitive dust and escape of liquid which has been in contact with ash. Liquid that drains from the ash must be collected and reused at the facility, unless the commissioner finds that reuse of the liquid is not feasible based on the design of the facility, in which case the commissioner may approve another management method. Floor or surface drains serving ash collection, storage, and handling areas must not be connected to uncontaminated storm water runoff drains. Except for ash samples collected and stored according to part 7035.2910, a municipal solid waste combustor may not store ash for more than five calendar days after the date the ash was generated. The maximum amount of ash stored at the facility must not exceed five days of daily production. The commissioner shall approve storage of a larger quantity of ash or storage for a longer period of time if the waste is kept in a contained area meeting the requirements of a solid waste storage facility under part 7035.2885.
