Part 7001.0170 - JUSTIFICATION TO COMMENCE MODIFICATION OF PERMIT OR REVOCATION AND REISSUANCE OF PERMIT The following constitute justification for the commissioner to commence proceedings to modify a permit or to revoke and reissue a permit:
A. alterations or modifications to the permitted facility or activity that will result in or have the potential to result in significant alteration in the nature or quantity of permitted materials to be stored, processed, discharged, emitted, or disposed of by the permittee;B. the commissioner receives information previously unavailable to the agency that shows that the terms and conditions of the permit do not accurately represent the actual circumstances relating to the permitted facility or activity;C. the agency or the federal government promulgates a new or amended pollution standard, limitation, or effluent guideline that is applicable to the permitted facility or activity;D. a court of competent jurisdiction invalidates or modifies a Minnesota or federal statute or rule or federal guideline upon which a condition of the permit is based;E. an event occurs that is beyond the control of the permittee that necessitates modification of a compliance schedule in the permit;F. the commissioner finds that the permitted facility or activity endangers human health or the environment and that a change in the operation of the permitted facility or in the conduct of the permitted activity would remove the danger to human health or the environment;G. the commissioner receives a request for transfer of the permit; orH. if applicable, there exists any justification listed in part 7001.0730, subpart 1, 7001.1150, or 7001.3550, subpart 2.Minn.
