Part 4770.1760 - DISTRIBUTION OF DRIED RAW CANNABIS; AGE VERIFICATIONSubpart 1.Sales only to those age 21 or older.A manufacturer shall distribute dried raw cannabis only to persons age 21 or older and as part of a pharmacist-approved transaction.
Subp. 2.Attainment of age.With respect to purchasing, possessing, consuming, and selling dried raw cannabis, a person is not 21 years of age until 8:00 a.m. on the day of that person's twenty-first birthday.
Subp. 3.Proof of age; defense.A. Proof of age for purchasing dried raw cannabis may be established only by:(1) a valid driver's license or identification card issued by Minnesota, another state, or a province of Canada, and including the photograph and date of birth of the licensed person;(2) a valid military identification card issued by the United States Department of Defense;(3) a valid Tribal identification card issued by a federally recognized Minnesota Indian Tribe;(4) a valid passport issued by the United States Department of State;(5) a valid instructional permit issued under Minnesota Statutes, section 171.05, to a person of legal age to purchase alcohol which includes a photograph and the date of birth of the person issued the permit; or(6) in the case of a foreign national, a valid passport.B. In an administrative enforcement action based on this part, the manufacturer may provide evidence that it reasonably and in good faith relied upon representations of proof of age authorized in item A in selling, dispensing, or distributing dried raw cannabis for an enrolled patient.Minn.
