Section R. 390.1487 - HearingRule 87.
(1) If a lender or participating school requests a hearing within the required 5 days before the proposed effective date of the limitation, suspension, or termination, the designated official shall schedule a hearing.(2) The hearing date shall not be less than 15 days after receipt of the request from the lender or the participating school.(3) A proposed limitation, suspension, or termination shall not take effect until a hearing is held.(4) The hearing shall be conducted and a decision rendered pursuant to the provisions of chapter 4 of Act No. 306 of the Public Acts of 1969, as amended, being S24.271 et seq. of the Michigan Compiled Laws.(5) If a termination action is brought against a lender or a participating school and the hearing officer concludes that a limitation is more appropriate, the hearing officer may issue a decision imposing 1 or more limitations on a lender or a participating school rather than terminating the lender's or the participating school's eligibility.Mich.
