Section R. 28.5102 - Noncriminal justice agency access to certain CJI for noncriminal justice purposes

Rule 102.

(1) Notwithstanding any provision within these rules, access to CJI that is criminal history record information for a noncriminal justice purpose is not subject to these rules but remains subject to all applicable federal and state law, the FBI Criminal Justice Information Services Security Policy, the Michigan Addendum to the FBI Criminal Justice Information Services Security Policy, and any procedures or requirements established by the department.
(2) As used in this rule, "noncriminal justice purpose" means access to CJI that is criminal history record information for use in connection with licensing or employment, or for a purpose unrelated to the administration of criminal justice that is not otherwise regulated under these rules, as authorized under federal law or a state statute pursuant to Public Law 92-544.
