Section R. 460.814 - Exemption from rules; application to commission; public hearing

Rule 4. An exemption from these rules may be granted by the commission. A party seeking an exemption shall file an application with the commission specifying the location to be exempted. After the filing of an application, the commission shall investigate the circumstances and shall determine if granting an exemption is in the public interest. The commission may conduct a public hearing in order to determine whether the public interest would be adversely affected by granting an application for an exemption to these rules. The commission may exempt a specific location from these rules for any of the following reasons:

(a) The cost of complying with the rules is not justified by the protection secured.
(b) Equivalent or safer construction is more readily provided in another manner.
(c) The rules are impractical for any other reason.
