Section R. 400.19606 - Designating public hearing requirementsRule 606.
(1) Within 60 business days after receiving a written request pursuant to the provisions of R 400.19608, the executive director shall hold a public hearing. The public hearing shall be held in the affected community so that interested persons and organizations may express their opinions, either orally or in writing.(2) The executive director shall implement the public hearing process as follows: (a) Not less than 10 days before the hearing, the executive director shall publish a notice of the hearing in a newspaper or newspapers of general circulation available to interested persons or organizations. Notice shall also be posted in public places accessible to interested persons or organizations. The notice shall be mailed to each affected unit of local government and any CAA currently serving any part of the community.(b) The notice shall indicate the type of request being considered and any tentative decision already made on the request.(3) After the public hearing, the executive director must consult with and obtain the advice of the commission regarding the proposed action before making a final decision. The commission shall be consulted at its first meeting following the public hearing.Mich. Admin. Code R. 400.19606
